By accessing or using the website at rupertchesman.com, you agree to be bound by these Terms of Service and all applicable laws and regulations. The website and all associated services are operated by Film Me Pty Ltd (ABN 57 612 132 395), trading as Rupert Chesman AI Learning Hub, with its principal place of business in Sydney, NSW 2000, Australia.
If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained on this website are protected by applicable copyright and trademark law. We reserve the right to refuse service to anyone for any reason at any time.
Throughout these Terms of Service, the following definitions apply. "Platform" refers to the website located at rupertchesman.com, including all subdomains, pages, and associated digital properties. "Services" means all courses, educational content, learning resources, community features, tools, and any other products or services offered through the Platform.
"User," "You," and "Your" refer to any individual or entity who accesses, browses, or otherwise uses the Platform. "We," "Us," "Our," and "Company" refer to Film Me Pty Ltd (ABN 57 612 132 395), its directors, officers, employees, and authorised agents. "Content" encompasses all materials available on or through the Platform, including but not limited to text, images, video, audio, course materials, downloadable resources, cheat sheets, templates, and any other media or documentation.
Certain features and Services on the Platform require you to create an account. When registering, you agree to provide accurate, current, and complete information, and to update such information as necessary to keep it accurate and complete. You are solely responsible for safeguarding your account credentials and for any activity that occurs under your account.
You must be at least 18 years of age to create an account. If you are under 18, you may only use the Platform with the involvement and consent of a parent or legal guardian, who will be responsible for your compliance with these Terms. We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been created in violation of these Terms.
Upon successful enrolment and payment, you will be granted access to the applicable course materials as described on the relevant course page. Enrolment entitles you to a personal, non-transferable licence to access and view the course content for your own educational purposes. The scope of access, including the duration and any supplementary materials, is specified at the point of purchase and may vary between courses and subscription tiers.
We reserve the right to update, modify, or improve course content from time to time to ensure accuracy and relevance, particularly given the rapidly evolving nature of artificial intelligence and related technologies. While we endeavour to maintain and improve courses, we do not guarantee that specific content will remain unchanged or available indefinitely. Any significant changes to course structure or scope will be communicated to enrolled users where practicable.
All prices displayed on the Platform are in Australian Dollars (AUD) unless otherwise stated, and are inclusive of Goods and Services Tax (GST) where applicable. Payment is processed at the time of enrolment or purchase, and you will receive a confirmation email upon successful payment. We accept major credit and debit cards and such other payment methods as may be displayed at checkout from time to time.
For subscription-based Services, your chosen payment method will be charged on a recurring basis at the interval specified at the time of purchase (monthly or annually) until you cancel. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to subscription Services until that date. We reserve the right to change our pricing at any time, although any price changes will not affect existing subscriptions until the next renewal period.
We offer a 14-day money-back guarantee on all course purchases. If you are unsatisfied with a course for any reason, you may request a full refund within 14 days of your original purchase date, provided that you have not completed more than 25% of the course content. To request a refund, please contact us at ru@rupertchesman.com with your order details and the reason for your request.
Approved refunds will be processed to your original payment method within 10 business days of approval. Please note that processing times may vary depending on your financial institution. This refund policy does not affect your statutory rights under the Australian Consumer Law, including your rights in relation to services that are not provided with due care and skill, or that are not reasonably fit for their intended purpose.
All Content on the Platform, including but not limited to course materials, videos, text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Film Me Pty Ltd or its content suppliers and is protected by Australian and international copyright, trademark, and other intellectual property laws. The compilation of all Content on the Platform is the exclusive property of Film Me Pty Ltd.
Your enrolment grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the course content solely for your own private, non-commercial educational purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Content from the Platform without the prior written consent of Film Me Pty Ltd. In particular, you may not use course materials to develop or offer a competing educational service or product.
Any content you submit to the Platform, including comments, reviews, forum posts, or other user-generated content, remains your property. However, by submitting such content, you grant Film Me Pty Ltd a worldwide, non-exclusive, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with the Platform and our business operations.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not share your login credentials with any other person or allow multiple individuals to access the Platform through a single account. Each account is for individual use only, and we may suspend or terminate accounts where we detect credential sharing or unauthorised access.
You must not use any automated means, including bots, scrapers, or spiders, to access, download, or copy Content from the Platform. You must not attempt to interfere with, compromise, or disrupt the Platform's infrastructure, security features, or other users' access. You must not use Content obtained from the Platform to create, develop, or operate a competing service, course, or educational product. You agree to comply with all applicable local, state, national, and international laws and regulations in your use of the Platform.
The courses, content, and resources provided through the Platform are for general educational and informational purposes only. They do not constitute professional, legal, financial, or technical advice. You should not rely on any Content as a substitute for professional advice tailored to your specific circumstances. We make no representations or warranties that completion of any course will result in particular employment outcomes, income levels, or professional certifications.
The field of artificial intelligence is evolving rapidly, and the tools, techniques, and platforms discussed in our courses may change, be discontinued, or be superseded after the course content is published. While we endeavour to keep our materials current, we cannot guarantee that all Content will reflect the latest developments at all times. The Platform and all Content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, to the fullest extent permissible under applicable law.
To the maximum extent permitted by law, Film Me Pty Ltd, its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Platform or any Content.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement. To the extent that our liability cannot be excluded, our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform is limited to the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Film Me Pty Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, your violation of any third-party right (including intellectual property rights), or any content you submit to the Platform. This indemnification obligation will survive the termination of these Terms and your use of the Platform.
We may suspend or terminate your account and access to the Platform at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Platform, or is otherwise objectionable. Upon termination for breach, your licence to access any purchased course content will be revoked immediately, and no refund will be due.
You may close your account at any time by contacting us at ru@rupertchesman.com or through your account settings. If you close your account voluntarily, your access to purchased courses will continue until the end of any pre-paid access period. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity provisions, and limitations of liability.
These Terms of Service shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in New South Wales, Australia, for the resolution of any disputes arising out of or relating to these Terms or your use of the Platform. Nothing in these Terms limits your rights to bring proceedings in any other jurisdiction where permitted by law.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you via email or through a prominent notice on the Platform at least 14 days before the changes take effect.
Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue your use of the Platform and close your account. We encourage you to review these Terms periodically to stay informed of any updates.
